How to Get Married in a Virginia Courthouse
Are you looking to have a quick civil marriage at a courthouse in Virginia? This short article will guide you through the necessary steps and show you how easy it is to get married in Virginia.
What do I need to get married at a Virginia Courthouse?
You need two items:
- A Virginia Marriage License
- An Officiant / Marriage Commissioner
Virginia Marriage License – This will cost you $30 and all you need to get one is an official ID (such as a driver’s license or passport). You can obtain your marriage license at any circuit courthouse in the Commonwealth of Virginia. If you are getting married here in the Winchester area, you can get one at either the Frederick County or Winchester City Circuit Courthouse which are both located on 5 North Kent Street, Winchester, Virginia 22601. It does not take long in Winchester, but I suggest allowing 15-20 minutes for them to do the paperwork.
Officiant / Marriage Commissioner – After you have your license you will need someone to actually perform the quick civil ceremony who is licensed by the court. I have been appointed by the circuit court and can perform a marriage ANYWHERE in the state of Virginia. Do we have to live in Virginia to get married there?
No, you don’t! You can reside in any state or country, and get married in Virginia. All you need is your official IDs to show the courthouse clerk when obtaining your marriage license.
Do we have to wait to get our marriage license in Virginia?
Nope, not at all. You can walk into any Virginia circuit court with your IDs and $30, and walk out in approximately 20-30 minutes with your marriage license. I often perform many same-day marriages!
Most Virginia Circuit Courts are open Monday – Friday from 9 a.m. – 5 p.m. Please check the court’s website for information on closings and holidays to ensure you don’t make a long trip only to find that the courthouse is closed.
Can we get married inside the courthouse?
What I usually do with my couples who want a quick wedding right at the court is have them step right outside to a nice waiting area away from indoor courthouse traffic. I then perform the civil ceremony right there which takes only 2-3 minutes. I then complete the marriage license and we return inside the courthouse where I file the paperwork immediately making the marriage 100% legal!
How old do we have to be to get married?
The minimum age for marriages in Virginia is 16 years old. However, if either of you is under 18 years of age, “consent to the marriage must be given in person by the father, mother or legal guardian of the minor.”
Do we need a witness for our civil marriage?
No, not at all. The only people whom need to be present is the two of you and me (marriage commissioner).
